Pixinoid ("Pixinoid," "we," "us," or "our") respects the privacy of its Users ("User," "your," or "you"). This Privacy Policy (the "Privacy Policy") explains how we collect, use, disclose, and safeguard your information when you use Pixinoid's platform, websites or apps ("Service").
Please read this privacy policy carefully to understand our policies and practices regarding your information and how we will treat it. By accessing or using our Services, you agree to accept all the terms in this Privacy Policy and acknowledge and agree with the practices described herein.

We do not share, sell, rent, manipulate or misuse any personally identifiable information you provide to us in any other way for commercial purposes. We do not share your personal information with third parties except as described in this Privacy Policy. We treat your personal information as we would treat our own.
For purposes of this Privacy Policy, the term “Personal Information” means any information that, alone or in conjunction with other information or data, identifies or is linked to a particular individual, household, or device, and that is subject to, or otherwise afforded protection under, a data protection law, statute, or regulation. A “Principal Entity” is an established entity and registered customer of Pixinoid that uses the Service to collect, share or collaborate on Content with other users. A Principal Entity might create “Album”s which are a collection of media uploaded by the Principal Entity or other users allowed by it.
When you create an account on the Service, we require that you voluntarily submit to us the following personally identifiable information ("Profile Information"), that allows us to contact or identify you -
You agree that we may use facial recognition technology to identify photos on the Service in which you appear when you add a reference photo to the Service. For example, our facial recognition technology will compare a selfie you upload with photos in albums to locate pictures of you. In addition, your responses to potential photo matches may improve the accuracy of the facial recognition technology. By using the Service and uploading your selfie, you consent to use facial recognition technology to identify photos on the Service in which you appear.
You represent that the selfie uploaded by you to the Service is you (or a family member for whom you are the legal guardian or have their consent) and that you are not impersonating or misrepresenting yourself as any other person or entity.
We solely gather your selfie, which undergoes conversion into a vector embedding representing your face. This representation is stored as a mathematical model, while the original image is promptly discarded.
Additionally, to verify the liveness of your face, we may collect a series of samples or selfies, which are also converted to vector embedding and processed for liveness verification.
When you access or use our Website or Service, we and our third party service providers may collect information from you through cookies, local-storage, web beacons, and other tracking technologies.
Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand user activity and patterns.
Local storage technologies, like HTML5 and Flash, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
When you access or use our Website or Service, our servers will automatically record log data which may include IP addresses, device and browser configurations, date and time of access, browsing times, and loading errors if applicable.
We may also manually collect usage logs from you, in case you report an issue with the Service to us.
When you make a payment or purchase any plan or subscription of the Service, you may be required to enter payment instrument details such as Card Number, Expiry, CVV etc., as well as your billing information, such as your Business Name, Address, TaxID etc.
We do not log, store or retain any payment instrument data you have entered while making a purchase on our Service.
We process all our payments through secure and trusted third-party payment gateways, and do not store or retain any payment instrument details that you may enter. Any payment instrument details collected through the Service are sent to the payment gateway, and not retained by us. The payment gateway provider may store this information such as for providing you a better experience, to comply with its legal obligations, to send you refunds incase it becomes applicable, etc. as per the privacy policy of the provider.

For complying with our legal obligations and to protect the integrity of our Services, we need to collect from you your billing information such as your official entity name, TaxID, address, etc. You voluntarily provide this to us before we allow you to make a payment to us. Some of the information such as your Tax ID, street address etc. may be left blank.
When you sign up for an account on Pixinoid, you voluntarily provide us with your Profile Information.
When you make a purchase of a plan or subscription of our Service, you provide us with your payment and billing details.
When you visit the website or use the Services, we collect information of your activity and usage from your interaction with the site. These may include your IP address, browser and device information, timestamps of your interactions on the site. This information is mainly collected automatically using cookies or other similar technology.
We may collect information from other services such as third party service providers, payment processors, or advertising services. These may include device and location information, limited information on your card used for payment, prior visits to our website, or whether you opened an email campaign.
We use the information collected primarily to provide you with our Service and to support our legitimate interests in operating our Service and business.
We require new users registering to provide us with Profile Information including their email and phone number, and to verify it using an OTP code sent to them. This is to prevent the abuse or misuse of our Services and to protect the data and privacy of other Users on the Service by preventing spam, bot and fraudulent accounts being created.
We use OTP send to email address or phone number of the user, as a mode to authenticate users on the Service. Additionally, we may send such OTPs to the user to verify and confirm certain high-security actions the user may undertake on the Service, such as account deletion, album deletion, etc.
We use your email address to communicate to you important changes to our policies, including but not limited to, policies such as Privacy Policy, Terms of Service, etc.
We also use your email to send you notifications about usage or actions involving your account or content you have created or shared on the Service, such as notifications on suspicious login, album deletion, subscription expiry etc.
We may occasionally also send you marketing emails with updates about the platform, or promotional offers we have for you. You may choose to opt-out of these marketing emails from the Service manage account page, or by clicking on the unsubscribe link in the footer of these emails.
The facial recognition data you provide us through uploading your selfie enables us to search and identify pictures of you on the Service. Pixinoid only uses facial recognition data to identify pictures of you on the Service.
We do not sell, trade, or rent any Personal Information derived from our use of facial recognition technology. We do not share any facial recognition data with any Principal Entity.
We may use and provide secure access to this information with third-party service providers who work on our behalf to administer and provide certain components or features of the Service.
Usage logs help us to provide you with safe, reliable and fast Service, and to improve our Service.
We may additionally provide some portions of the usage logs collected to Principal Entities to allow them to analyse, monitor, and improve their services.
We use your payment and billing information to process your payments and to provide you with the Service you have purchased. We do not store or retain any payment instrument data you have entered while making a purchase on our Service, and this information is always directly sent to our payment gateway provider.
We may use your billing information to comply with our legal obligations, such as tax compliance, and to protect the integrity of our Services.
Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent, or share your Personal Information with third parties, unless you ask or authorize us to do so.
If you do not want us to use or share Personal Information collected about you in the manners identified in this Privacy Policy, you may not use the Service.
By signing up for the Service through an invite, such as a link, code or QR code, provided by a Principal Entity or otherwise registering to access Content shared by a Principal Entity, you give Pixinod the consent to share your Profile Information with the Principal Entity.

Please note that any use of your Profile Information by the Principal Entity is governed strictly by your relationship with the Principal Entity and the Principal Entity’s own privacy policy, if any. Pixinoid is not responsible for and disclaims any liability regarding, the Principal Entity’s use of any of your Profile Information obtained via the Services or otherwise. You make your Profile Information available to the Principal Entity at your own risk and with your consent.
We shall share your information with our third-party Service Providers who provide and support our Service. We will only share the information required for the Service Provider to complete the service and require them to use the information in a manner consistent with this policy.
Third-party service providers we use include hosting and content delivery services, analytics platforms, AI processing services, customer support management services, payment processors and our communication gateway partners like AWS, Stripe, etc.
We have ensured that the respective privacy policies of these providers align with our values.
We may share your information with third-party advertising networks (such as Facebook and Instagram) to deliver advertisements of our Service to you and to manage our communications with you. We do not use your Content for this purpose.
We also do not sell, trade, rent or otherwise share in any form, any personal information we collect from you to other advertisers or marketing entities.
In the case of a merger, acquisition, financing, reorganization or sale, information collected may be shared on the basis that it is subject to standard confidentiality arrangements.
Some of your profile and user-generated content (such as comments posted) are visible to other users of the Service and the public. This information can be seen, collected, used or shared by others, and we are not responsible for any such use of information.
We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose your Personal Information to government or law enforcement officials or private parties if we believe in good faith that such disclosure is necessary or appropriate to

We may also disclose your Personal Information to professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
Pixinoid follows industry standards for the management of personal information. We employ technical and administrative safeguards intended to protect against accidental or unlawful destruction, loss, alteration and disclosure of personal information.
We maintain security measures such as the use of redundancies and employ firewalls to protect against unlawful access and network vulnerabilities. While we have safeguards in place, as no method of storage or transfer of information over the Internet is completely secure, we cannot guarantee the absolute security of your personal information.
We will retain your Profile Information for as long as your account is active or as long as needed to provide you with the Service.
We may also retain and use your information to comply with our legal obligations, resolve disputes, enforce our agreements and protect our interests.
When you do not use the Service for a continuous period of 3 years, we will deactivate your Account. We shall store your Profile Information until your Account is deactivated for non-usage.
You may anytime delete your Account through the Service dashboard or by contacting us at support@pixinoid.com, in which case your Personal information will be deleted.
We may continue to retain anonymized information, that is not identifiable to you, to ensure the integrity of our Service and to help us improve our Service.
Pixinoid does not retain or store the selfie you upload beyond the duration necessary for the completion of the search and identification process of pictures of you on the Service.
The facial recognition is retained to enable us to notify you when new photos featuring you are uploaded to the Service. You may opt out of this feature or delete your facial recognition data anytime through the Service dashboard.
We shall continue to retain all Content on an Album of Principal Entity, for as long as it has an active subscription plan. This includes photos of you any photo you uploaded to the Album etc. which shall be retained even if your Account is deleted, as these Content are considered to be part of the Album, owned by the Principal Entity. For the removal of any Content, you agree to contact the Principal Entity directly.
When the Principal Entity’s subscription to an Album on Pixinoid is terminated, expired or cancelled, we shall delete all Content (”Expired Content”) of the Album as per our Terms.
We may retain such Expired Content for a maximum of six (6) months from the date of expiry of the plan and thereafter may store some information in an aggregated and anonymized format.
We may keep your Content after your account has been suspended or terminated where we consider it necessary for evidential purposes relating to a breach of our Terms or with respect to current or anticipated action by any competent enforcement authority or other third party.
As part of providing the Service to you, your Personal Information might be transferred, stored or processed in a country other than where you are located.
By providing your information, you consent to such transfer and processing.
Our Sites may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.
Some web browsers incorporate a "Do Not Track” feature. Because there is not yet an accepted standard for how to respond to Do Not Track signals, our Website or Service does not currently respond to such signals.
We do not knowingly collect Personal Information from anyone under the age of majority in their state or province of residence, as per the laws of the country of residence of the User.
By using our Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use our Service. If you are a parent or guardian who has become aware that your child has provided us with information without your consent, you are required to promptly report it to us at support@pixinoid.com.
